Terms of Service

1. Agreement

By creating a Jatelo account or using the Jatelo mobile or web app (the "Service") you agree to these Terms of Service. If you do not agree, do not use the Service. Jatelo is operated from South Africa.

2. Your account

The minimum age to use Jatelo is 16 in the EU/EEA and UK, and 13 elsewhere (subject to higher local minimums). You are responsible for keeping your login credentials secure and for all activity that happens under your account. Notify us at support@jatelo.app if you suspect unauthorised access.

3. Acceptable use

You agree not to:

  • Use the Service for anything illegal, abusive, or fraudulent
  • Upload content you do not own or have permission to share
  • Impersonate another person or entity
  • Scrape, reverse-engineer or attempt to disrupt the Service or its infrastructure
  • Submit deliberately false safety information (e.g. fake river grades, fake hazard warnings) — paddlers rely on this data

We may suspend or terminate accounts that violate these rules.

4. Your content

You retain ownership of everything you upload — logs, photos, routes, reviews. By posting public content you grant Jatelo a non-exclusive, worldwide, royalty-free licence to host, display and distribute it inside the Service so other users can see it. You can delete your content at any time.

5. Strava and other connected services

Jatelo offers an optional integration with Strava and may add other integrations over time. Use of these integrations is subject to the terms of the underlying service:

By connecting Strava you authorise Jatelo to read your paddle activities and athlete profile from Strava on your behalf. You can disconnect at any time from your Jatelo profile, which immediately revokes the token. See our Privacy Policy for the full data list.

Jatelo is not endorsed by or affiliated with Strava. Strava is a trademark of Strava, Inc.

6. Subscriptions and payments

Some features of Jatelo (collectively "Jatelo Pro") require a paid subscription. Web payments are processed by Paystack in ZAR. Mobile in-app subscriptions are processed by Apple App Store or Google Play and managed through RevenueCat.

Auto-renewal. Jatelo Pro auto-renews until cancelled. Payment is charged to your payment method at the start of each billing period (monthly or annually). Subscriptions renew at the then-current price for the same period unless you cancel at least 24 hours before the end of the current period.

Cancelling. Web subscribers can cancel from Profile → Settings → Subscription. Mobile subscribers cancel through their App Store or Play Store account settings — Jatelo cannot cancel an Apple or Google subscription on your behalf. Cancellation stops the next renewal; access continues until the end of the period already paid for.

6a. Jatelo Pro pricing and free trial

Jatelo Pro is billed monthly at R99 or annually at R799 (standard), or R699 for the first 500 Founders in year one only. Every new subscription begins with a 7-day free trial. On day 8, payment is automatically charged unless you cancel before that date in your account settings. Trial eligibility is limited to one trial per user account. If payment fails on day 8, your Pro access is paused until a payment method is updated; no charge is processed during the paused state.

Founder pricing applies to year one of an annual subscription only; subsequent renewals are charged at the standard annual rate (R799). The Founder badge is permanent once earned, regardless of renewal or cancellation status.

6b. Refunds and EU right of withdrawal

Mobile (Apple / Google). Refunds for App Store and Play Store subscriptions are handled directly by Apple or Google under their respective refund policies. Jatelo does not process mobile refunds.

Web (Paystack). Outside the EU/UK, cancellations made after a billing date are not refunded for the current billing period. Access continues until the end of the period already paid for.

EU/UK consumers — 14-day withdrawal right (CRD Art. 9). If you are a consumer in the EU/UK you normally have 14 days from the start of a subscription to withdraw, without giving a reason, and receive a full refund. By starting your free trial or paid subscription you may be asked to expressly consent and acknowledge that you lose the right of withdrawal once access to Pro content has begun (CRD Art. 16(m) — digital content supplied on a non-physical medium). If you have not expressly waived this right, you may withdraw within 14 days by emailing support@jatelo.app with your account email and we will refund the unused portion.

7. Safety disclaimer — outdoor and water sports

Jatelo is a planning and logbook tool, not a navigation or safety device. River grades, hazards, water levels, weather, GPS tracks and route information are user-submitted and may be incomplete, out of date, or wrong. GPS accuracy varies with device, signal and conditions and must not be relied upon for navigation in emergencies.

You are solely responsible for assessing risk and your own ability before entering the water or any other outdoor environment. Always check local conditions, paddle with appropriate gear and personal flotation, file a float plan, and never paddle alone if conditions are beyond your level. By using Jatelo you acknowledge that paddling and other outdoor sports carry inherent risk of injury or death and you assume that risk.

8. Service availability

We aim to keep the Service available 24/7 but cannot guarantee uninterrupted access. Maintenance, third-party outages (Supabase, Strava, Mapbox, Paystack, app stores) and incidents may cause downtime. We may add, change or remove features at any time.

9. Disclaimer of warranties

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Nothing in these terms excludes or limits any mandatory consumer rights you have under the law of your country of residence (e.g. EU/UK statutory warranties, the South African Consumer Protection Act).

10. Limitation of liability

To the maximum extent allowed by law, Jatelo, its operators, contractors and processors are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or personal injury sustained while engaged in any outdoor activity planned or logged using the Service. This clause does not limit liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be limited under applicable law.

11. Termination

You may delete your account at any time from profile settings or by emailing support@jatelo.app. We may suspend or terminate accounts that violate these terms or applicable law. On termination your data is deleted in accordance with our Privacy Policy.

12. Governing law and consumer protection

These terms are governed by the laws of the Republic of South Africa. If you are a consumer resident in the EU, UK, or another jurisdiction with mandatory consumer-protection rules, you also benefit from the mandatory protections of the law of your habitual residence (Rome I Regulation Art. 6 for EU consumers), and nothing in these terms deprives you of those rights. Disputes may be brought in the courts of your country of residence where the law requires.

13. Changes to these terms

We may update these terms as the Service evolves. Material changes will be announced inside the app and by email where appropriate. Continued use of the Service after a change means you accept the updated terms.
